Terms & Conditions of Sale

The Company means Rapid Mobility or subsidiary company as appropriate.

All quotations are made and orders accepted subject to the following conditions. Any other terms, conditions, amendments of warranties whatsoever are excluded from the contract or any variations thereof unless expressly accepted by the Company in writing.

Quotations are open for acceptance for a maximum period of 30 days from the date thereof and maybe withdrawn by the Company at any time by written, facsimile or oral notice.

Times and dates for delivery, installation, repairs or other works are given as accurately as possible but are not guaranteed. The customer shall have no right to damages or to cancel the order for failure, for any cause, to meet any times or dates stated.

Failure of the customer to give reasonable notice that delivery, installation, repairs or other works cannot take place at the agreed date and time shall mean the customer will pay such additional costs, expenses or losses incurred by the Company.

Cancellation will only be agreed by the Company on condition that all costs and expenses incurred by the Company up to the time of cancellation, and all loss of profit and other loss or damage resulting to the Company by reason of such cancellation will be paid forthwith by the customer to the Company.

Risk shall pass to the Customer upon delivery so that the customer is responsible for all loss, damages or deterioration to the good independent of passing title.

Title to the goods or any relevant part thereof shall be retained by the Company until the customer has paid to the Company all sums due under the contract or when the Company serves notice on the customer in writing specifying that title in the goods or part thereof has passed.

The Company may recover goods in respect of which title has not passed to the customer at any time and the customer hereby licenses the Company, its officers, employees and agents to enter upon the premises of the customer for the purposes of recovering any goods in respect which title has not passed to the customer.

Prices are unless otherwise stated, quote net ex, works exclusive of VAT. Alterations required by the customer shall be chargeable extra.

Payment shall be immediate unless otherwise agreed by the Company. The Company shall be entitled without prejudice to any other right or remedy to charge interest on the outstanding amount at the rate of 5% per annum above the base rate of Barclays Bank. For scooter sales where the scooter is to be ordered from a distributor, payment must be made to place the order. Confirmation of payment will be provided in writing by post if not in store.

A cooling off period for 14 days from receipt of the product will be available for non-bespoke products bought over the phone or online only. A cooling off period of seven days is unavailable for non-bespoke products bought in store if unused with the original packaging and receipt. The company will not buy back any items sold from the customer, unless agreed upon by a Director of the company in writing. 

Returns within cooling-off periods will receive a full refund excluding delivery costs, both standard and special delivery fees. If the product is returned to the Company by post, returns must be made at the cost of the customer and should be packaged in such a way that no damage is made to the product in transit. The customer will be liable for any damage caused in transit or any reduction of product value due to use, misuse, neglect or accident. We advise parcel tracking to be purchased for the return. If a Refund is approved by the company, the refund will be processed up to 14 working days of the product being received back to the company and after the customer’s request of cancellation notice.

If the company decides to accept a return request outside the cooling-off period: any products returned that were purchased either in store, over the phone, or online, will incur a 30% restocking fee of the original sale price.

In the event of a defect on the goods supplied becoming apparent within the guarantee or warranty period stated in the contract or, if not stated, 12 months of delivery date on brand new products or 3 months of delivery date on second hand products. The Company shall itself or by an authorised dealer/repair agent, effect any repair or replacement deemed necessary by the Company, free of charge, subject to:

  1. Full payment having been made under the terms of the contract.
  2. The goods or part having been properly maintained and not being obsolete.
  3. The goods or part not having been damaged by neglect, accident or improper use.
  4. Fair wear and tear.
  5. The goods or part not having been altered or repairs having been attempted by any other person or agency. Fair wear and tear.
  6. Repair works are guaranteed for 3 months unless stated otherwise.
  7. Batteries are guaranteed for 3 months unless stated otherwise.

Items of a consumable nature will not normally be covered during the warranty period unless such items have suffered undue wear as a fault of an original manufacturing defect.

The company reserves the right to replace sold second-hand or used parts or goods with second hand parts or goods under the warranty. 

Warranties of any kind do not include any call out, travel and/or labour fees.

The Company shall not be liable or responsible for any death or injury in any circumstances except that which is the direct result of negligence by the Company or its operations. Further under no circumstances whatsoever shall the Company be liable for consequential (including removal or rectification works required in connection with installation of repaired substitute goods) death or injury.

The Company shall not be under any liability for any delay, loss or damage caused wholly or part by act of God, governmental restriction condition, or control or by reason of any act done or not done pursuant to a trade dispute whether such dispute involves its office or employees or not or by reason of any other act, matter or thing beyond its reasonable control including failure by the other party to carry the provisions of these conditions.

 

Sale on Behalf – Commission Agreement 
 

Please be advised that our "Sale on Behalf" commission agreement has been in place since 2021. As per this agreement, we will deduct a 25% commission from the agreed sale price of any mobility item sold through our services. *Effective 24/11/25, all new “Sale on Behalf” items accepted by the company will be sold subject to a minimum 35% commission from the agreed sale price (increased from the previous 25%). If the product is sold for more than the agreed sale price, the company reserves the right to retain any excess amount. In addition, In the event that an offer is received below the agreed sale value and the original owner cannot be contacted, the company reserves the right to reduce the agreed amount by up to 10%.*

This commission applies regardless of whether any paperwork has been signed, and by engaging us to sell a mobility item on your behalf, you acknowledge and accept these terms.

Terms & Conditions of Hire

1. Cancellations for hire periods less than 7 days will be accepted at no charge up to 3 working days before the hire start date. Cancellations for hire
periods longer than 7 days will be accepted at no charge up to 4 working days before the start date. Cancellations received after these respective
days will be charged at the full hire fee including any delivery costs.
2. The hirer is responsible for any accidental damage to the hire product/s and/or any damage caused as a result of misuse or neglect. The hirer is
responsible for any loss of the hire product/s or accessories whilst in their possession. The hirer is responsible for charging power chairs and
scooters. If the product and or its accessories are lost, stolen, not charged or misused whilst in the hirerÕs possession they accept that they will be
charged the cost of replacing the product or accessory and pay for any loss of earnings between the date of loss and the date of the replacement
product being ready for use.
3. The hirer may be charged a callout fee if fault is due to non-charging, loss or damage caused by the hirer, or by any third-party whilst the hire
product/s is in the hirers possession.
4. Rapid Mobility will be responsible for the working function of the hire and any call out due to fault incurred through normal use will not be charged,
i.e. electrical/mechanical fault.
5. Rapid Mobility will replace any faulty hire for the completion of the hire period at no charge. No other renumeration for cancelling part of the hire
period with or without fault to Rapid Mobility is available. This includes if you decide to cut your hire period short, you will not be entitled to any
refund.
6. Non return of the hire or unavailability of collection on the due date will result in charging at the full daily rate for each day or part thereof that the hire
is not returned or available to collect.
7. All hires are for single person use only unless stated otherwise. The carriage of passengers including children is prohibited. All hires should only
be used the named operator. If it is found that the hirer has let another person use the scooter or an additional person at the same time. We
reserve the right to collect the hire product with immediate affect and no refund offered as this will be classed as deliberate misuse.
8. In the event that we have delivered a scooter to the required venue and on your arrival the scooter has been taken by someone else, rapid mobility
accepts no responsibility for this incident and will charge a further callout fee, as well as an extra hire fee to provide a replacement and/or rectify the
issue. Our team will arrange a safe and agreed delivery with the customer and accept no responsibility once delivered.
9. Once you hire products from Rapid Mobility Ltd you are accepting these terms and conditions, including over the phone hire, website enquiries, in
person hires, or hires on behalf of others.

All hire scooters are limited to a maximum speed of 4 mph for insurance purposes. No refunds will be issued if a customer requests or prefers a faster machine.

VAT EXEMPTION

You must diclare your disability to us prior to hire, otherwise we legally obligated to charge VAT on top of the hire amount.
I declare that I am chronically sick or disabled and that I am receiving from Rapid
Mobility Ltd the above goods which are being supplied to me for my own use and that I
claim relief from Value Added Tax under group 12 of schedule 8 to the Value Added Tax
Act 1994. Please note that there are severe penalties for making a false declaration.
